RF Recovery operates this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience (the "Services"). RF Recovery is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when using the Services.

Please read these Terms carefully, as they include important information about your legal rights, including warranty terms, warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services.

By agreeing to these Terms, you represent that you are at least 18 years of age, or are using the Services under the supervision of a parent or guardian.

Placing an order is an offer to purchase. We reserve the right to accept or decline any order at our discretion. Your order is not accepted until we confirm acceptance, and payment must be received and processed first.

Please review your order carefully, as we may be unable to accommodate cancellation requests once an order is accepted. If we cancel or amend an order, we will attempt to notify you using the contact details provided at checkout.

Purchases are subject to return or exchange in accordance with our Refund Policy. Nothing in this section affects your rights under the Australian Consumer Law.

You represent that your purchases are for personal or household use and not for commercial resale or export.

Section 4 — Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time of order, as confirmed in your order confirmation email. Unless stated otherwise, posted prices do not include shipping, handling, or import charges where applicable. All prices are in Australian dollars (AUD) and include GST where applicable.

You agree to provide accurate billing and payment information and to keep it up to date.

Section 5 — Shipping and Delivery

Delivery times are estimates only and not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our reasonable control. Risk of loss passes to you once the order is handed to the carrier, except where this would be inconsistent with your rights under the Australian Consumer Law.

Section 6 — Intellectual Property

Our Services — including trademarks, branding, text, images, graphics, and design — are owned by RF Recovery, its affiliates, or licensors, and are protected by Australian and international intellectual property laws.

You may use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, or create derivative works from any material on the Services without our prior written consent.

RF Recovery's names, logos, and slogans are trademarks of RF Recovery. Shopify's name and branding are trademarks of Shopify. All other trademarks belong to their respective owners.

Section 7 — Optional Tools

We may provide access to third-party tools that we do not control or monitor. These are provided "as is," without warranty, and your use of them is at your own risk. We accept no liability arising from your use of third-party tools.

Section 8 — Third-Party Links

The Services may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of these sites, and accessing them is at your own risk.

Section 9 — Relationship with Shopify

RF Recovery is powered by Shopify, which enables us to provide the Services. Sales made through our store are made directly with RF Recovery. Shopify is not responsible for any aspect of these sales, including any loss or damage resulting from purchased products.

Section 10 — Privacy Policy

Personal information collected through the Services is handled in accordance with our Privacy Policy. By using the Services, you acknowledge that you have read it.

Because the Services are hosted by Shopify, some personal information may be transmitted to and processed by Shopify, including in jurisdictions outside Australia.

Section 11 — Feedback

If you submit feedback, reviews, or suggestions, you grant us a worldwide, royalty-free licence to use, reproduce, and publish that content for any purpose, including commercial use. You represent that you own the rights to any feedback you submit and that it complies with these Terms.

We may, but are not obligated to, monitor or remove feedback we consider unlawful, offensive, or in breach of these Terms.

Section 12 — Errors, Inaccuracies and Omissions

Information on the Services may occasionally contain typographical errors or inaccuracies relating to pricing, descriptions, or availability. We reserve the right to correct these and to cancel orders affected by inaccurate information, without prior notice.

Section 13 — Prohibited Uses

You agree to use the Services only for lawful purposes. You must not use the Services to violate any law, infringe intellectual property rights, harass or harm others, transmit false information, spam, or interfere with the security of the Services. We reserve the right to suspend or terminate your access at any time for breach of these Terms.

Section 14 — Termination

We may terminate your access to the Services at our discretion, without notice. You remain liable for any amounts due up to the date of termination. Provisions that by their nature should survive termination (including Intellectual Property, Warranty, Liability, and Governing Law) will continue to apply.

Section 15 — Disclaimer of Warranties

The Services and all products are provided "as is" and "as available," without warranties of any kind except as required by law and except as expressly set out in our warranty in Section 16. We do not guarantee that the Services will be uninterrupted, timely, or error-free.

Nothing in this section excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

Section 16 — Product Warranty

RF Recovery (ABN 80 523 067 140) provides the following voluntary warranty against defects, in addition to the consumer guarantees you are entitled to under the Australian Consumer Law.

16.1 Our 12-Month Warranty

RF Recovery warrants that our products will be free from defects in materials and workmanship under normal use for 12 months from the date of original purchase. This warranty is provided by RF Recovery, ABN 80 523 067 140, and applies to the original purchaser only. It is not transferable, and proof of purchase is required for any claim.

16.2 What Is Covered

Within the 12-month period, this warranty covers defects arising from normal use, including:

• Structural defects in the compression sleeves or housing
• Electrical or mechanical failure of the control unit not caused by misuse
• Faults in components supplied with the product, including hoses and connectors
• Defective materials or workmanship in manufacturing

16.3 What Is Not Covered

This warranty does not cover:

• Damage caused by accident, misuse, abuse, or neglect
• Normal wear and tear consistent with the age and use of the product
• Damage resulting from failure to follow the product instructions or care guidance
• Unauthorised modifications, disassembly, or repairs
• Cosmetic damage that does not affect function, such as scratches or surface marks
• Loss or damage occurring during return transit where the product was not packaged adequately

16.4 How to Make a Claim

To make a warranty claim, email us at rfrecovery01@gmail.com with your order number or other proof of purchase, a clear description of the defect, and photos or a short video showing the issue. We will acknowledge your claim within 5 business days and let you know the next steps. If we ask you to return the product for assessment, we will tell you in advance who is responsible for the return shipping cost.

16.5 Our Remedy

If your claim is accepted under this voluntary warranty, RF Recovery will repair the product, replace it, or refund it. Where we are choosing the remedy under this voluntary warranty, that choice is ours. This does not limit the remedies you are entitled to under the Australian Consumer Law (see Section 16.6). Where the law gives you the right to choose a remedy, those rights apply in addition to this warranty.

16.6 Your Rights Under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

The benefits given by this warranty are in addition to other rights and remedies available to you under the Australian Consumer Law. These consumer guarantees apply regardless of the 12-month warranty period above. A product may be required to be of acceptable quality, and remain so, for a period that a reasonable consumer would expect given its price and nature.

Section 17 — Limitation of Liability

To the extent permitted by law, RF Recovery and its officers, employees, and affiliates will not be liable for any indirect, incidental, or consequential damages arising from your use of the Services or products purchased through them.

This limitation does not apply to the extent it would exclude or limit any right or remedy you have under the Australian Consumer Law in relation to faulty, unsafe, or misdescribed goods. Where permitted by law, our liability for a failure to comply with a consumer guarantee is limited, at our option, to the repair or replacement of the goods, or the cost of doing so.

Section 18 — Indemnification

You agree to indemnify and hold harmless RF Recovery, Shopify, and our respective affiliates from any claims or losses arising from your breach of these Terms, your violation of any law, or your use of the Services.

Section 19 — Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

Section 20 — Waiver; Entire Agreement

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision. These Terms constitute the entire agreement between you and RF Recovery regarding use of the Services.

Section 21 — Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign or transfer our rights without notice to you.

Section 22 — Governing Law

These Terms are governed by the laws of New South Wales, Australia. You and RF Recovery submit to the non-exclusive jurisdiction of the courts of New South Wales.

Section 23 — Headings

Headings are included for convenience only and do not affect the interpretation of these Terms.

Section 24 — Changes to Terms of Service

We may update these Terms at any time by posting changes to this page. Your continued use of the Services after changes are posted constitutes acceptance of those changes.
